The Management of Health and Safety at Work Regulations 1999 require employers to protect non-smokers from discomfort caused by tobacco smoke. This may mean the provision of a separate room for smokers or banning the use of the substance in the workplace. Tobacco smoking in the workplace may result in health and safety hazards for your workforce through the presence of environmental tobacco smoke (ETS) and fire hazards. Passive smoking may present health risks where tobacco smoke can be inhaled by others (Passive Smoking), Whilst employers may risk a claim for compensation for damage to health from passive smoking they also risk action by enforcing authorities for not taking appropriate action such as carrying out a risk assessment and putting control measures in place.
